Terms of Use

The terms on which Blaecwood Systems Limited, RC 9229729, makes blaecwood.ng and the NDPA classification tool available. They are not an engagement contract and do not describe the terms of any work we may do for you.

1. General information, not advice

Everything on this website is general information about regulatory and compliance topics. It is not legal, regulatory or compliance advice, and it is not a substitute for advice on your own circumstances. Requirements differ by organisation and change over time. Do not act, or decide not to act, on the basis of anything published here without taking advice on your own position.

2. No client relationship is created

Reading this website, running the NDPA classification tool, sending us a message or booking a call does not create a client, adviser or DPCO relationship between you and Blaecwood Systems Limited, and does not place us under any duty to you.

A relationship begins only when scope, terms and fees are agreed in writing and signed by both sides. Until that point no work has begun on your behalf, and nothing you send us should be treated as confidential in the way it would be during an engagement.

3. The NDPA classification tool

The tool at ndpa.blaecwood.ng is an indicative self-assessment. It reflects the answers you give and nothing else, and it does not verify them.

It is not an NDPA compliance audit and does not constitute a compliance opinion. It is not a Compliance Audit Report, a Data Protection Impact Assessment or a DPCO Verification Statement, and it cannot be filed with or relied on by the Nigeria Data Protection Commission. Your classification under the Act is a matter for the Commission.

4. Intellectual property

The content of this website, including its text, structure, design and code, belongs to Blaecwood Systems Limited or is used with permission, and is protected by applicable intellectual property law.

You may read the site and print or save individual pages for your own reference. You may not republish, redistribute or sell the content, present it as your own, or use it to build a competing product or service, without our written permission.

5. Limitation of liability

The website is provided on an "as is" basis. We take care over what we publish, but we do not warrant that the content is complete, current or free from error, or that the site will be available uninterrupted.

To the fullest extent permitted by Nigerian law, Blaecwood Systems Limited is not liable for any loss or damage arising from your reliance on the content of this website or on the output of the NDPA classification tool, including any indirect or consequential loss, loss of profit, loss of business or loss of data.

Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law.

These terms, and any dispute arising out of or in connection with them or your use of this website, are governed by the laws of the Federal Republic of Nigeria and subject to the jurisdiction of the Nigerian courts.

We may change these terms. The version published here at the time you use the site is the version that applies, and the date above is the date of the current version.
